Article 1 (Scope)
These Terms of Service (the “Terms”) set forth the terms and conditions for use of the website provided by Indie Heart Games (URL: https://indieheartgames.blogspot.com; hereinafter the “Website”) and the application provided by the Operator on various platforms (e.g., Apple App Store for iOS, Google Play for Android; hereinafter the “App”). By installing the App or using the Website, users agree to these Terms.
Article 2 (Registration, etc.)
If user registration is required in the App, users shall register accurate and up-to-date information. If any registered information changes, users shall promptly notify the Operator.
Article 3 (Conditions of Use / Prohibited Conduct)
Users shall not engage in any of the following acts (including but not limited to):

Acts violating laws, regulations or public order and morals;

Acts that infringe the rights of others (including copyright, portrait rights, privacy, etc.);

Unauthorized access, cheating, tampering, transmitting or distributing viruses, etc.;

Excessive commercial activities or spamming;

Fraudulent acquisition, sale, or transfer of multiple accounts;

Other acts the Operator deems inappropriate.
If the Operator determines that a user has violated the preceding paragraph, the Operator may, without prior notice, suspend use by that user, temporarily freeze the account, delete data, or take other measures. Except in cases of willful misconduct or gross negligence on the part of the Operator, the Operator shall not be liable for any resulting damages.
Article 4 (Paid Services, Purchases, Refunds)
The App may offer advertising and in-app purchases. The introduction of advertisements and types of purchasable items may be changed at the Operator’s discretion; the Operator will notify users in advance as necessary.
Payments for purchases are processed through the payment systems of the relevant platforms (e.g., Apple App Store, Google Play). Inquiries and responses regarding payments and refunds are generally handled in accordance with the policies of those platforms. If the Operator handles a case individually, the Operator will provide separate guidance.
The Operator records purchase events (such as purchase date/time and product ID), but does not store payment information such as credit card numbers.
Article 5 (Content and Intellectual Property Rights)
Copyright and other intellectual property rights in the content of the App and the Website (including text, images, programs, etc.) belong to the Operator or the rightful right holders. Users shall not reproduce, modify, redistribute, or otherwise use such content without the Operator’s prior written permission.
Article 6 (Disclaimer / Limitation of Liability)
The Operator provides the Service on an “as-is” basis. Except for cases of willful misconduct or gross negligence by the Operator, the Operator shall not be liable for service interruptions, suspensions, data loss, malfunctions, or other issues.
The Operator’s liability for direct damages suffered by a user due to causes for which the Operator is responsible shall be limited to the total amount paid by that user for the Service during the twelve (12) months immediately prior to the event giving rise to liability. This limitation shall not apply in cases of willful misconduct or gross negligence by the Operator. Indirect damages (including lost profits) are excluded from compensation.
If a user causes damage to a third party as a result of using the Service, the dispute shall be resolved at the user’s responsibility and expense, and the Operator shall not be liable.
Article 7 (Temporary Suspension / Termination of Service)
The Operator may temporarily suspend or terminate the provision of the Service for maintenance, failure response, force majeure, or other operational reasons. While the Operator will give notice of important changes to the extent possible, the Operator shall not be liable except in cases of willful misconduct or gross negligence.
Article 8 (Privacy)
The handling of users’ personal information is governed by the separate Privacy Policy. The contact form may use external services such as Google Forms, in which case the handling of data by such external services also applies.
Article 9 (Modification of the Terms)
The Operator may modify these Terms as necessary. Revised Terms shall take effect from the time the Operator notifies them by the method specified by the Operator. If a user continues to use the Service after the revised Terms take effect, the user shall be deemed to have agreed to the changes.
Article 10 (Governing Law and Jurisdiction)
These Terms shall be governed by and construed in accordance with the laws of Japan. Any dispute arising out of or relating to these Terms shall first be resolved by sincere consultation between the parties. If the dispute cannot be resolved, the Tokyo District Court shall have exclusive jurisdiction as the court of first instance.
